On January 7, 1961, Martin G. Thompson, respondent, petitioned the Trempealeau county court to declare Emil P. Nelson incompetent
to manage his own property, and further petitioned the court to have him, Thompson, appointed Nelson's guardian. The petition,
drawn pursuant to sec. 319.07, Stats., listed Louis Nelson, an incompetent brother of Emil Nelson's, as the only interested
heir. In fact, there were 21 other interested heirs at the time the petition was filed. A hearing was held on February 7,
1961, and at that time Nelson was adJudged incompetent and Thompson was appointed his guardian. Although notice of the hearing
had been served on Emil Nelson, he was not physically present during the incompetency hearing. Subsequent to Thompson's appointment, he brought Nelson from a rest home operated under religious auspices in Arpin, Wisconsin,
to the Thompson home in the town of Blair, Wisconsin. The record establishes that Nelson preferred to stay in the rest home,
rather than live with Thompson. From December of 1961 until the time of his death in October, 1962, Nelson lived in Thompson's
home and in the Trempealeau county hospital.
